This Warranty is in lieu of, and excludes, all other Warranties, expressed or implied, including without limitation, any implied warranty arising from course of dealing, course of performance, or course of trade the implied Warranties of merchantability and fitness for a particular purpose and any obligation or liability arising from tort of for loss of use, revenue or profit. CWS Industries (Mfg) Corp. will not be held responsible for any incidental or consequential damages or expenses of any kind whatsoever.
Any Warranty approved by CWS Industries (Mfg) Corp. and performed by the dealer or its customer will be honored by the issuance of a CREDIT to the purchasing dealer to be applied toward future purchases. This statement sets forth the entire warranty and any oral statements cannot be relied upon and are not part of this Agreement. |
